Objectives:
• Delays where the contractor is not at fault would normally constitute a valid claim for (EOT).
• Delays affects critical path of projects.
• Confirming a delay and/ or disruption is not an easy task: it is a time-consuming process, especially in multifaceted projects with thousands of activities, a lot of details, as well as the involvement of many stakeholders.
• It is important for clients, contractors, sub-contractors, and consultants to understand the fundamental requirements of compiling a successful EOT claim, and the adjudication of claims submitted.
• These training notes will provide those involved in the preparation and adjudication of EOT claims under the JBCC with some essential information to deal more productively with this complex matter.
• On larger projects, the magnitude of time-related costs can easily run into millions of rand. With so much at stake, it is understandable that delay claims are a major source of disputes in the construction industry.
• The proper assessment of delay claims is essential so that the parties can deal with it without having to resolve the dispute in expensive and drawn-out arbitration or litigation processes.

Learning Outcomes:
- Implement approval of the contractor consenting to a nominated subcontractor to assign or cede to his rights and obligations.
- Hold the contract documents (if so, agreed in the contract data).
- Supply the contractor with drawings, un-priced bills of quantities and other documents as listed in the schedule at the expense of the employer.
- Notify contractor of delegations of authority of agents
- Deal with notices received from contractor where any agent fails to act in terms of delegated authority.
- Timeously accept the design undertaken by a selected subcontractor
