• Delays where the contractor is not at fault would normally constitute a valid claim for (EOT). • Delays affects critical path of projects. • Confirming a delay and/ or disruption is not an easy task: it is a time-consuming process, especially in multifaceted projects with thousands of activities, a lot of details, as well as the involvement of many stakeholders. • It is important for clients, contractors, sub-contractors, and consultants to understand the fundamental requirements of compiling a successful EOT claim, and the adjudication of claims submitted. • These training notes will provide those involved in the preparation and adjudication of EOT claims under the JBCC with some essential information to deal more productively with this complex matter. • On larger projects, the magnitude of time-related costs can easily run into millions of rand. With so much at stake, it is understandable that delay claims are a major source of disputes in the construction industry. • The proper assessment of delay claims is essential so that the parties can deal with it without having to resolve the dispute in expensive and drawn-out arbitration or litigation processes.

• The building contract involves a host of role players to establish a successful project – role players all have specific functions to be performed within specific boundaries, with specific powers entrusted to them. • Role players must work together to ensure a successful project is completed within timeframes and with professionalism, integrity, honesty and moral standards. • Some functions are regulated by contracts between role players, but others are governed by the standards laid down by society – the so-called boni mores of a community. • Role players must be aware of the impact of their actions. • It is imperative that all parties involved in a project have proper detailed knowledge of their respective roles, powers, duties, timelines and application of specialised professional contributions to the “team.” • It is the function of the principal agent to bring all the aspects, required for a successful building project, together in a coordinated and orderly manner. • The role of the principal agent therefore requires a proper understanding or else a project may fall apart to the detriment of all parties involved. • If the role of the principal agent is not fully understood, chaos may be the result in which all parties suffer financial loss, impaired reputations and environmental damage.
